Terms and Conditions for Car Owners

Eligibility and Registration

  • Requirements for listing a car: Owners must be the owner or holder (in case of Leasing) of the car (e.g.,title or registration), valid insurance, and up to date vehicle inspection. The car must be less than 20 years old and have fewer than 300 000 kilometers. Exemption can be made for unique cars (e.g. older wedding car).

Listing Requirements

  • Accurate description and photos: Owners must include:
    • Detailed information about the car (make, model, type, special features).
    • High-quality photos from multiple angles (front, back, sides, interior, and any notable damage).
  • Maintenance and safety standards: Cars must undergo regular maintenance, including:
    • Oil changes.
    • Tire rotations and checks.
    • Brake inspections.
    • Fluid level checks (e.g., coolant, brake fluid).
  • Prohibited Listings: Cars that are:
    • Older than 20 years or with more than 300 000 kilometers.
    • Having significant mechanical issues, safety concerns, or extensive damage.
    • With unauthorized or unsafe modifications (e.g., illegal tinting, non-standard exhaust systems).
    • With unresolved safety recalls.
    • Without valid MOT.
  • Documentation: On demand Owners must provide:
    • Proof of ownership.
    • Valid insurance.
    • A recent vehicle inspection report.
  • Cleanliness and Presentation: Cars must be:
    • Clean and free of personal items.
    • Vacuumed carpets and seats.
    • Clean windows and mirrors.
    • No trash or personal belongings left in the car.
  • Availability and Booking: Owners must:
    • Keep their car’s availability up to date.
    • Respond to booking requests promptly, within 24 hours.

Pricing and Payments

  • Setting rental prices: Owners can set daily, weekly, and monthly rental rates. The platform may suggest competitive pricing based on similar listings in the area.
  • Payment processing and fees: Car owners receive payments directly from renters. At the end of each month, we send an invoice to the car owners for the 10% service fee. Commission can vary based on separate agreements.
  • Security Deposit: Car owner collect security deposit by him/her-self. Security deposit is not collected or kept by the website.

Owner Responsibilities

  • Ensuring the car is in good working condition: Owners must:
    • Ensure the car is clean, fueled, and free of personal items before each rental.
    • Provide a full tank of gas or specify the fuel level policy.
  • Providing necessary documents:
    • Owners must leave a copy of the car’s registration, insurance, and a contact number in the glove compartment for renters.

Insurance and Liability

Car owner is responsible for the car insurance and repairs in case of damage. Autorentals.lv is not insuring or anyhow responsible for car damage.

Cancellation and Refunds

  • Policies for cancellations by the owner: Owners can cancel bookings up to 24 hours after receiving reservation. Cancellations after 24 hours or 24 hours (or less) before renting time start may result in a fee equivalent to one day’s rental.
  • Refund procedures: Refunds are processed within 5-7 business days. Owners may not receive full payment for last-minute cancellations.

Dispute Resolution

  • Process for handling disputes with renters: Owners should document any issues with photos and communicate with renters through the platform’s messaging system. If unresolved, the platform’s support team will mediate.
  • Mediation and arbitration options: If mediation fails, the according to local law car owner can turn to local authorities.
  • Security Deposit: Car owner collect security deposit by him/her-self. Security deposit is not collected or kept by the platform.

Terms and Conditions for Renters

Eligibility and Registration

  • Age and licensing requirements: Renters must be at least 18, 21 or 25 years old (defined by owner) and possess a valid driver’s license with no major traffic violations in the past three years.
  • Verification process: Renters must verify their identity using a government-issued ID and provide a any other requested documents by the car owner.

Booking and Payments

  • How to book a car: Renters can search for available cars, select dates, and book through the platform. Instant booking available and Renter must register to book a car. Renters must agree to the terms and conditions before booking.
  • Payment methods and security deposits: Renters must pay security deposit & full payment directly to the car owner. A security deposit (typically €50-€100, amount defined by the car owner). Renter & Car owner themselves agree about the payment method.

Renter Responsibilities

  • Proper use and care of the car: Renters must:
    • Use the car responsibly, follow all traffic laws, and avoid prohibited activities such as off-roading, racing, or towing.
    • Keep the car clean and return it with the same fuel level.
  • Returning the car on time and in the same condition:
    • Late return fee is defined individually by each car owner. Renters are responsible for any damage, excessive wear and tear, or missing items.

Prohibited Uses

  • Activities that are not allowed: Renters must not use the car for:
    • Illegal activities.
    • Off-roading (unless specifically listed as an off-road vehicle).
    • Racing.
    • Towing.
    • Transporting hazardous materials.
    • Partying.
    • Smoking (defined by car owner).
  • Violations may result in penalties and liability for damages.

  • Process for handling disputes with renters: Renters (incl. Owners) should document any issues with photos and communicate with renters through the platform’s messaging system. If unresolved, the platform’s support team will mediate.
  • Mediation and arbitration options: If mediation fails, the according to local law car renter (incl. owner) can turn to local authorities.

General Terms

Platform Responsibilities

  • Role of the platform in facilitating rentals: The platform acts as an intermediary, connecting owners and renters. It is not responsible for the condition of the cars or the actions of users. The platform provides customer support and handles payment processing.
  • Limitations of liability: The platform’s liability is limited to the extent permitted by law. Users agree to hold the platform harmless for any issues arising from rentals, including but not limited to mechanical failures, accidents, or disputes.
  • Security Deposit: Car owner collect security deposit by him/her-self. Security deposit is not collected or kept by the platform. Any disputes regarding Security Deposit must be handled directly among Car owner and Renter.

Amendments

How and when terms can be updated: The platform reserves the right to update terms and conditions at any time. Users will be notified of significant changes via email or platform notifications. Continued use of the platform constitutes acceptance of the updated terms.

Governing Law

Jurisdiction and applicable laws: The terms and conditions are governed by the laws of the jurisdiction where the platform operates. Disputes will be resolved in the appropriate courts of that jurisdiction.
